Why fees are usually paid by the building owner
The work benefits the building owner, so the award normally directs them to meet the reasonable costs of the process, your surveyor included.
If they refuse
- Your surveyor will usually chase the building owner directly.
- If the building owner thinks the fee is too high, the issue can be referred to the third surveyor.
- Sums due under an award can be recovered as a civil debt through the courts.
Will I end up paying?
Normally not, where the award places the fees on the building owner. Check your surveyor's terms at the start: some ask the adjoining owner to sign an appointment that mentions fees, but the award is what decides who pays.
Fees before an award
If the project is abandoned before an award, the position on fees can be less clear. Ask your surveyor at the outset how they handle this.
